These conditions (and all communications) are in English and governed by, and will be construed in accordance with, English Law, and the English courts shall have jurisdiction in any legal proceedings.

Right of Private Individuals to Cancel Services requested other than in the course of a business

Where services are requested via Nelsons' websites the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (which apply only to private individuals acting outside the course of their business) give you the right to cancel any instructions up to 14days commencing the day after they were given.

This right does not apply to the provision of Financial Services.

We will not commence the supply of our services to which rights of cancellation apply within the cancellation period referred to unless you confirm your instructions to us via Nelsons websites. Our service to you will commence immediately upon our acknowledgement of your instructions. If you subsequently exercise your right to cancel we will be entitled to charge you for the value of the services we provide prior to receipt of your cancellation.

You accept that the normal 30 day period during which services are to be provided under the Regulations shall not apply. The reason for this is that in most cases it is impossible for us to conclude your matter within that time period for reasons beyond our control.

If you wish to cancel your instructions you MUST DO SO IN WRITING delivered personally or sent (which may be by email to chris.miller@nelsonslaw.co.uk) to Managing Partner Nelsons Solicitors Limited, Pennine House, 8 Stanford Street, Nottingham NG1 7BQ.

Any written cancellation by you of your instructions will be deemed to have been served as soon as it is received by us.

You can navigate this website to explore what is available at no cost but in order purchase any of our products or submit a general enquiry you must first register.

If you are an individual you must be aged 18 years or over to do so.

Only when you have purchased a product will your username and password give you full access to Product Services.

Restrictions on Use

Product Services are for your personal use only (unless, in respect of the wills service, you are an individual acting on behalf yourself and a partner, spouse or civil partner or, in the case of any business service, you are an authorised person on behalf of that business). You shall not permit any other person or entity to have access to the Product Services. If you breach this term we can, without notice, revoke your username and password and refuse further access to these services.

Product Services

This website offers 2 separate services the terms and conditions of each of which are separate and distinct from the others:-

  1. The Document Assembly Service
  2. The Document Review Service

Document Assembly Service

The Document Assembly Service does not provide legal advice nor represent a legal service. It is designed to enable you to collect relevant information and data to assist in the assembly of a document.

The Document Assembly Service uses document assembly and drafting software. When using the Document Assembly Service you will be asked a series of questions; the answers you give will dictate the content of the document produced. You alone are responsible for ensuring the answers, or any information that you give, are correct (this includes, but is not limited to, information in relation to the identity of any parties or signatories, their age or capacity).

You must carefully check that the document produced fully reflects your wishes. If it does not, you should not sign it. It is your responsibility to ensure that any document is properly signed and completed in accordance with any guidance provided.

Document content accords with the law of England & Wales. You should not use these documents in any other jurisdiction, or, if any person or entity who is to sign it or the property the document deals with, is outside the jurisdiction of England & Wales.

Before you act or rely on any documents, you should take legal advice. We disclaim all liability for actions taken or not taken based on the documents unless the documents are approved by us as part of our Document Review Service the availability of which is outlined in the product description (see further below).

The Document Review Service

The Document Review Service is available only for those documents as outlined in each product description and is provided by us as part of a Limited Engagement by you. Once a document has been drafted using the Document Assembly Service, if you wish us to review it, you must send it electronically using the "Submit for Review" button on the website. We may contact you by telephone or email to clarify your requirements or if there is anything in the document which you have assembled which is obviously incorrect or you raise any questions on submission.

When we advise you on any document we will exercise reasonable skill and care in the provision of this service to you in accordance with our Limited Engagement letter. We will perform our work as quickly as is reasonably possible.

To assist you in deciding whether to purchase the Document Review Service where the product gives you the option not to do so, the scope of the work we will carry out is set out in our Limited Engagement letter which, for your guidance in advance of your decision, includes:-

  • Review of the answers you gave the assembly software;
  • Review of the draft document that has been produced following your session on the Website;
  • Communications with you electronically via email; where required, an interview to be conducted either over the telephone and/or in person subject to the service levels set out on the website relating to the service you have purchased; confirmation to you based on such communications and/or interview that we are satisfied that the draft document meets your requirements; answering any questions you may have raised when sending the document to us for review;
  • Any amendments that are required to the draft document to ensure its suitability for your particular circumstances in so far as you advise us of them.


The General Provisions relate to all services where applicable.

Document Packs

A document pack comprises a range of documents created using the Document Assembly Service. The details of what is included in the pack are detailed on the Website.

Retention of Documents

Documents that you have completed online using the Try Before You Buy service (Trial Documents) will be stored online for a minimum period of two years; other Documents completed and/or reviewed online will be stored for a minimum period of six years. After these periods you may not be able to obtain access to your Documents or Trial Documents as they may have been deleted. We reserve the right to levy a reasonable recovery charge in respect of any Documents or Trial Documents that are capable of being recovered. If you have not logged in to the Website for a period of twelve months or more, then we reserve the right to store your Documents or Trial Documents offline and levy a reasonable recovery charge for you to access them again.


The telephone helpline for legal advice (only available to purchasers of specific products where Helpline access is included in the product description) and for technical support will be available in accordance with the times advertised on the website. You may contact the helpline on the number provided. Calls may be recorded for training, compliance and security purposes.

Telephone legal advice is limited to purchasers of specific products and only, if, at our sole discretion, it is suitable to be given by telephone.


Repayment - Having paid for the Document Review Service, if you do not submit the document for review within 12 months of purchase you will not be able to obtain access to this service thereafter. In such circumstances we shall not have any obligation to rebate you any part of the sum you have paid us.

Solicitor/client relationship

No solicitor-client relationship is established simply by sending or receiving information through this website or using the Document Assembly Service alone. Where required, we will establish a solicitor-client relationship with you on your acceptance of our Limited Engagement the terms of which will be supplied as part of the Document Review Service and subsequent confirmation that we are able to act for you.

Website Access facility

We have a facility that enables us to access your account, or any documents you have created or started, and perform actions as if we were you. We will only ever use that facility when it is necessary in order to action a support request that you have made to us, whether by email or by telephone. You consent to us using this facility in this way when you accept the Conditions. By accepting the Conditions, you also agree to comply with the instructions we may give you to ensure that the use of this facility is effective. For the avoidance of doubt, we shall not ever, unless you are on a telephone call with us at the time and specifically provide your consent, use this facility to accept any contractual terms or other legal acknowledgements, or to make any payments, on your behalf.


We will not have any responsibility or liability for:

  • Verifying your answers or any information given by you when using the Document Assembly Service;
  • Proof reading the data you have input for typographical errors;
  • Any alterations made by you or on your behalf to a document once it has been returned to you by us unless such alteration has been approved by us;
  • Supervising or checking the due, proper and valid signing of any document;
  • Any use of a document or execution of a document by a person or entity outside of the jurisdiction of England & Wales;
  • Any adverse consequences if you use or rely on any document without taking appropriate further legal advice as to its suitability for your particular circumstances from us;
  • Taxation consequences of the terms of your Will or taxation advice generally;
  • Potential claims against your estate or challenges to the validity of your Will on any ground including lack of capacity, undue influence and want of knowledge or approval;
  • Undertaking any future review of any document or to provide any advice, legal or otherwise, as to the continuing effectiveness for legal, taxation or any other purpose of any document unless we have expressly agreed to do so under the Limited or other formal Engagement

Intellectual Property

Use of the Website and our Services is subject to the notices of ownership of intellectual property rights detailed from time to time on the website.

Other Conditions

If any part of these conditions (and/or notices on the website) are found to be invalid or unenforceable, then such part will be deemed replaced by a valid and enforceable provision that most closely matches the intent or the original part, and the remainder of the provision shall continue in full force and effect.

We reserve the right to change the conditions under which the website or any User Service is offered.

Correspondence will not be entered into, nor will formal representation be undertaken in any legal proceedings relating to drafting documents other than within the scope of the Document Review Service, reviewing documents or correspondence, or providing any legal and/or regulated advice under Solicitors Regulation Authority or Financial Conduct Authority rules.

You may not assign, subcontract or otherwise transfer any rights and obligations under these Conditions, whether in whole or in part, without our prior written consent. We shall be able to assign the benefit of all or part of these Conditions to any company or other entity which is from time to time part of Nelsons Solicitors Limited.

Headings in these Conditions are for convenience only and shall not affect their interpretation.

These Conditions represent the entire agreement between the parties other than as varied by the terms of any limited or other engagement.

In the event that your complaint relates to any acts or omissions on our part under the Limited Engagement or other engagement for the provision of legal services, our obligations to you under Rule 2.05 Solicitors Code of Conduct 2007 remain unaffected.

  1. If you encounter any problems, including anything relating to our bill, or financial services products, try to resolve them with your lawyer or the named Partner first. If the problem is not resolved, you have the right to complain direct to the Managing Partner Chris Miller who will implement our internal Complaints Procedure, a copy of which will be supplied to you at the time. If your complaint is still not resolved, provided you do so ordinarily within 6 months of our written response to your complaint, you can refer the matter to the Legal Ombudsman by telephone on 0300 555 0333, by email to enquiries@legalombudsman.org.uk or in writing to the Legal Ombudsman, PO Box 6806, Wolverhampton WV1 9WJ. The Legal Ombudsman's powers do not extend to all clients.
  2. There may be a right to object to our bill by applying to the court for an assessment of the bill under Part III of the Solicitors Act 1974. The Legal Ombudsman may not accept a referral if the court assessment process has been started.
  3. If all or part of a bill remains unpaid, Nelsons may be permitted to charge interest on unpaid sums.
  4. In the event of an unsuccessful challenge to our charges, we reserve the right, so far as our professional rules permit, to charge you for the work done and any expenses payable by us as a result.
